At Keyshift Strategies, we understand the importance of staying informed about maritime industry developments. Today, we’d like to share some valuable information about the Federal Maritime Commission’s (FMC) services that could be particularly helpful during the current East-Gulf Coast port labor strike.
The FMC has recently issued a friendly reminder to freight forwarders and NVOCCs about the various assistance options available to navigate these challenging times. Let’s break down these services in a clear and approachable manner:
1. Dispute Resolution and Problem-Solving
The Office of Consumer Affairs and Dispute Resolution Services (CADRS) is here to help! They can:
- Facilitate resolutions for business disputes
- Help find solutions when cargo flow is interrupted
- Guide you on how to address issues with ocean shipments
2. Challenging Improper Charges
If you believe you’ve been incorrectly charged, including for detention and demurrage, you have options:
- File a Charge Complaint for a quick review of your claim
- This process is faster and less formal than traditional methods
3. Seeking Compensation
For those looking to recover damages, you can:
- File a formal claim to be heard by an Administrative Law Judge or a Small Claims Officer.
- Disputes must be related to statutes administered by the Commission (such as detention and demurrage and the Shipping Act).
4. Reporting Violations
The Bureau of Enforcement, Investigations, and Compliance is vigilant about maintaining industry standards:
- They review allegations of violations by common carriers or MTOs
- All regulated entities must comply with FMC statutes and regulations
5. Important Reminders
The FMC has emphasized several key points:
- All fees and surcharges must be reasonable and clearly defined
- 30-day notice is required for new fees or surcharges from common carriers and MTOs
- Demurrage and detention invoicing must follow new rules effective May 28, 2024
How to Take Action
If you suspect any violations, you can:
- File a formal complaint for adjudication
- Report allegations to the Bureau of Enforcement, Investigations, and Compliance
- Share concerns and information with the FMC at complaints@fmc.gov
At Keyshift Strategies, we’re committed to keeping you informed and helping you navigate these complex situations. Remember, the FMC is actively engaging with stakeholders to address supply chain challenges. If you have any questions about how these services might apply to your business, don’t hesitate to reach out to us or the FMC directly.
Stay tuned for more updates, and let’s work together to keep our maritime operations running smoothly!
